Notion of interest
Juro é um valor exigido ou prometido além da restituição de um capital emprestado.
Interest is a value exacted or promised over and above the restitution of a borrowed capital.

- juros compensatórios, que indenizam o credor pelo risco real que ele corre de perder seu capital, a perda que ele sofre ou o ganho do qual ele se priva ao se desvencilhar de seu capital durante o período do empréstimo, e de
- juros lucrativos, que é um emolumento que o credor não ganharia sem emprestar.

- lucrative interest, which is an emolument that the lender would not gain without lending.
O interesse origina-se no empréstimo de bens para consumo, o que permite ao tomador gastar ou destruir as coisas emprestadas, com a condição de devolver um número igual do mesmo tipo ou qualidade. A quantia a ser paga pelo uso de um artigo, que deve ser devolvido, é chamada de aluguel. Tudo que é consumido pelo uso: milho, vinho, óleo, frutas, etc., pode ser objeto de um empréstimo (sentido anterior), mas, ordinariamente, é uma quantia em dinheiro que é emprestada.
Interest originates in the loan of goods for consumption, which permits the borrower to expend or to destroy the things lent, on condition of giving back an equal number of the same kind or quality. The sum to be paid for the usage of an article, which must itself be given back, is called hire. Everything which is consumed by usage: corn, wine, oil, fruit, etc., can be the matter of a loan (former sense), but ordinarily it is a sum of money which is lent.

É permitido emprestar com juros? Antigamente (ver USURA), a Igreja rigorosamente condenava a cobrança de qualquer valor além do capital, exceto quando, em razão de alguma circunstância especial, o credor corria o risco de perder seu capital ou não podia conceder seu empréstimo sem se expor a uma perda ou à privação de um ganho. Essas razões especiais, que autorizam a cobrança de juros, são chamadas de títulos extrínsecos.
Is it permitted to lend at interest? Formerly (see USURY) the Church rigorously condemned the exacting of anything over and above capital, except when, by reason of some special circumstance, the lender was in danger of losing his capital or could not advance his loan of money without exposing himself to a loss or to deprivation of a gain. These special reasons, which authorise the charging of interest, are called extrinsic titles.
Além desses juros compensatórios, a Igreja também admitiu os juros moratórios. Em nossos dias, ela permite a prática geral de empréstimos com juros, ou seja, autoriza o imposto, sem que se precise averiguar se, ao emprestar seu dinheiro, houve perda ou privação de ganho, desde que se exija um juro moderado pelo dinheiro emprestado. Essa exigência nunca é injusta. Somente a caridade, não a justiça, pode obrigar alguém a fazer um empréstimo gratuito (veja as respostas da Penitenciária e do Santo Ofício desde 1830).
Besides these compensatory interests, the Church has likewise admitted moratory interest. In our day, she permits the general practice of lending at interest, that is to say, she authorizes the impost, without one's having to enquire if, on lending his money, he has suffered a loss or deprived himself of a gain, provided he demand a moderate interest for the money he lends. This demand is never unjust. Charity alone, not justice, can oblige anyone to make a gratuitous loan (see the replies of the Penitentiary and of the Holy Office since 1830).
Qual é a razão para essa mudança na atitude da Igreja em relação à cobrança de juros? Como pode ser visto mais detalhadamente no artigo USURA, essa diferença se deve a circunstâncias econômicas. O preço dos bens é regulado por uma avaliação comum, e esta, pela utilidade que sua posse costuma trazer em um determinado centro. Agora, hoje, ao contrário de antigamente, pode-se comumente empregar o dinheiro de forma frutífera, pelo menos colocando-o em um sindicato. Assim, hoje, a mera posse de dinheiro significa um certo valor. Aquele que entrega essa posse pode reclamar em retorno esse valor. Portanto, é assim que se age ao exigir um juros.
What is the reason for this change in the attitude of the Church towards the exaction of interest? As may be more fully seen in the article USURY, this difference is due to economical circumstances. The price of goods is regulated by common valuation, and the latter by the utility that their possession ordinarily brings in a given centre. Now, today, otherwise than formerly, one can commonly employ one's money fruitfully, at least by putting it into a syndicate. Hence, today, the mere possession of money means a certain value. Whoever hands over this possession can claim in return this value. Thus it is that one acts in demanding an interest.

Mesmo hoje ainda se pode pecar contra a justiça ao exigir um juro excessivamente alto, ou usura, como é chamada. Que juro, então, é justo e moderado? Teoricamente, e de uma forma abstrata, a taxa justa de juros corresponde quase ao ganho médio que aqueles que se dedicam ao comércio podem geralmente esperar em um determinado centro. Ela corresponde quase, pois o juro é garantido, enquanto o lucro é incerto; devemos descontar o valor de um prêmio de seguro do lucro médio. Assim, em um determinado centro, se aqueles que aplicam seu dinheiro em edifícios, terrenos ou empreendimentos industriais geralmente buscam um lucro de 6 por cento, a taxa justa de juros será de cerca de 4 ou 5 por cento. Essa taxa cobre os riscos e os inconvenientes ordinários do empréstimo. Mas se alguém tiver que correr riscos especiais ou tiver que abrir mão de um prêmio extraordinário, poderia, em justiça, exigir uma taxa de juros mais alta. Tal, portanto, é a regra teórica. Na prática, no entanto, como até mesmo a resposta da Sagrada Penitenciária mostra (18 de abril de 1889), o melhor caminho é conformar-se aos costumes estabelecidos entre os homens, exatamente como se faz em relação a outros preços e, como acontece no caso desses preços, circunstâncias particulares influenciam a taxa de juros, seja aumentando ou diminuindo-a. Dessa forma, a segurança oferecida pelos adiantamentos aos governos de países ricos e aqueles que cobrem hipotecas diminui a taxa para empréstimos públicos e empréstimos hipotecários. Pelo contrário, o juro sobre transporte marítimo e negócios mercantis é mais alto do que o nos negócios civis, em razão da maior incerteza nas viagens marítimas e nas empreitadas comerciais.
Even today one can still sin against justice by demanding too high an interest, or usury, as it is called. What interest then is just and moderate? Theoretically, and in an abstract way, the fair rate of interest nearly corresponds to the average gain that those engaged in business may generally expect in a determined centre. It nearly corresponds, for the interest being guaranteed, whilst the profit is uncertain, we must discount the value of an insurance premium from the average profit. Accordingly, in a determined centre, if those who sink their money in buildings, land, or industrial undertakings generally look for a profit of 6 percent, the just rate of interest will be about 4 or 5 percent. This rate covers the risks and ordinary inconveniences of lending. But if one had to run special risks or had to give up an extraordinary premium, one might in all justice exact a higher rate of interest. Such, therefore, is the theoretical rule. In practice, however, as even the answer of the Sacred Penitentiary shows (18 April, 1889), the best course is to conform to the usages established amongst men, precisely as one does with regard to other prices, and, as happens in the case of such prices, particular circumstances influence the rate of interest, either by increasing or lowering it. In this way, the security offered by advances to the governments of wealthy countries and those that cover mortgages diminish the rate for public loans and loans on mortgage. On the contrary, the interest on shipping, and mercantile business is higher than that in civil business, on account of the greater uncertainty in sea voyages and in commercial enterprise.
