Uma casa religiosa (monastério ou convento) é uma residência fixa de pessoas religiosas. Presupõe, portanto, a habitação contínua de uma comunidade propriamente dita, governada por um superior e seguindo a regra prescrita pela respectiva ordem. Tal casa religiosa deve ser distinguida de uma granja ou fazenda, de uma villa ou lugar de recreação, e de um hospice ou lugar para a recepção de religiosos em viagem. As condições para a legítima ereção de um monastério são:
A religious house (monastery or convent) is a fixed residence of religious persons. It supposes, therefore, continuous habitation of a community strictly so called, governed by a superior and following the rule prescribed by the respective order. Such a religious house is to be distinguished from a grange or farm, from a villa or place of recreation, and from a hospice or place for the reception of travelling religious. The conditions for the legitimate erection of a monastery are:
- a permissão da Santa Sé. Isso é certo para países sujeitos ao Decreto "Romanos Pontifices" (ou seja, os Estados Unidos, Inglaterra, etc.); é também exigido para a Itália. Fora da Itália e de países missionários em geral, a questão é muito debatida por canonistas;
- o assentimento do ordinário. Esta condição foi aprovada pelo Concílio de Calcedônia em 451, e esteve em vigor até o século XII. No século XIII, os privilégios das ordens mendicantes causaram frequentes derrogações à lei, mas a antiga disciplina foi restaurada pelo Concílio de Trento (Sess. XXV, de Reg., cap. iii). Esta permissão não pode ser dada pelo vigário-geral nem pelo vigário-capitular. Antes que o bispo dê seu assentimento, ele deve se familiarizar com as opiniões daqueles a quem tal monastério poderia ser prejudicial, como os superiores de outras ordens religiosas já estabelecidas lá, ou o povo do local. O sacerdote da paróquia não pode opor-se, a menos que se pretenda conferir direitos paroquiais à nova casa religiosa;
- deve haver uma provisão adequada para o sustento de doze religiosos, caso contrário, eles devem viver sob a jurisdição do ordinário. Esta última condição, entretanto, não se aplica a países onde o "Romanos Pontifices" está em vigor.
- the permission of the Holy See. This is certain for countries subject to the Decree "Romanos Pontifices" (i.e. the United States, England, etc.); it is also required for Italy. Outside of Italy and missionary countries generally, the question is much disputed by canonists;
- the assent of the ordinary. This condition was approved by the Council of Chalcedon in 451, and was in force as late as the twelfth century. In the thirteenth, the privileges of the mendicant orders caused frequent derogations from the law, but the ancient discipline was restored by the Council of Trent (Sess. XXV, de Reg., cap. iii). This permission cannot be given by the vicar-general nor by the vicar-capitular. Before the bishop gives his assent, he should make himself acquainted with the opinions of those to whom such a monastery might prove a detriment, as the superiors of other religious orders already established there, or the people of the place. The parish priest cannot object, unless it is intended to confer parochial rights on the new religious house;
- there must be a proper provision for the sustenance of twelve religious, otherwise they must live under the jurisdiction of the ordinary. This last condition does not, however, apply to countries where the "Romanos Pontifices" is in force.
Para a transferência de um mosteiro de um local para outro na mesma localidade, não é necessária a permissão da Santa Sé, uma vez que se trata de uma tradução, e não de uma ereção. Havia uma lei antiga que proibia a ereção de um novo mosteiro dentro de uma certa distância de um mais antigo, mas essa norma caiu em desuso. Em relação aos conventos de religiosas, é necessário o assentimento do ordinário, mas não o da Santa Sé. O mesmo se aplica à ereção de casas de congregações piedosas e institutos.
For the transfer of a monastery from one site to another in the same locality, no permission of the Holy See is required, as this is translation, not erection. There was an ancient law that a new monastery could not be erected within a certain distance from an older one, but it has gone into desuetude. As regards convents of religious women, the assent of the ordinary is required, but not that of the Holy See. The same holds for the erection of houses of pious congregations and institutes.
